REGULATIONS ON THE USE OF THE WEBSITE “REAL IS BEAUTIFUL STOCK”
General provisions
The regulations on use of the website “REAL IS BEAUTIFUL STOCK” (hereinafter – the Website) (hereinafter – the Regulations) provide for the conditions of use of the Website and the rights and obligations of the users of the Website (hereinafter – the Website users). By using the Website you acknowledge that you have got familiarised with the conditions of the Regulations and undertake to unconditionally and irrevocably observe all requirements set forth in the Regulations. The persons who do not carry out the registration procedure shall also be bound by the Regulations.
The Website is administrated by UAB New Agency, legal entity code 302704981, address: A. Goštauto g. 40, LT-03163 Vilnius (hereinafter – the Website Administrator). The Website Administrator shall have the right to unilaterally amend and/or supplement these Rules at any time. Amendments to the Regulations shall enter into force from their publication on the Website. Where, after publication of amendments to the Regulations, the Website user continues using the Website, it shall be considered that he has unilaterally agreed with all amendments to the Regulations.
Website users shall be provided with a possibility to share photos representing Lithuania. The Website user, who uploads a photo onto the Website, agrees that the photos may be used for the purposes of promotion of tourism, improvement of image and raising awareness of Lithuania.
Registration of the Website users
The Website user, who wishes to upload a photo onto the Website, must get registered. The procedure of registration shall be carried out by clicking on the respective link on the Website and filling in all mandatory fields of the registration form, specifying the forename, surname and e-mail address (hereinafter – the Data).
For the purpose of carrying out the registration, a Website user undertakes to provide correct Data. It shall be prohibited to carry out the registration using other persons’ data or communicating to third parties the password and login name used by the Website user.
The Website Administrator undertakes to ensure the confidentiality of the Data and refrain from disclosing the data to third parties.
The Website Administrator shall process the Data in accordance with legal acts and the Privacy Policy. The purposes and methods of processing personal data shall be specified in the Privacy Policy.
Obligations of the Website users
The Website user, while using the Website, must:
• act in compliance with provisions of legal acts applicable in the Republic of Lithuania and these Regulations;
• upload the photos reflecting the objects that are located in the territory of the Republic of Lithuania;
• refrain from uploading on the Website the photos the content of which could allow identifying a particular person, unless the permission of such persons has been obtained;
• refrain from uploading on the Website the photos that could infringe the right of third parties to private life and its secrecy, as well as other rights and lawful interests;
• refrain from uploading onto the Website the photos of advertising nature, i.e. the photos disseminating information related to economic – commercial, financial or professional activities, encouraging to acquire goods or to use services; and refrain from uploading the photos that are defaming in respect of other persons; are indecent, insulting or inciting hatred; are of pornographic nature; incite violence or discrimination on the grounds of race, gender, religion, nationality, disability, sexual orientation or age; and also the photos of any type that could violate requirements of legal acts or promote conduct incompatible with legal acts.
Uploading of photos
Only those photos that are approved by the Website Administrator shall be published on the Website. The Website Administrator shall have the right not to approve the photos that do not comply with the conditions of these Regulations or legal acts of the Republic of Lithuania.
By uploading a photo on the Website, the Website user confirms that: (i) he is the author of the photo or has all rights necessary for the lawful uploading of the photo onto the Website; (ii) the uploading of the photo does not violate legal acts of the Republic of Lithuania and the rights or lawful interests of third parties.
By uploading a photo on the Website, the user grants an authorisation (a non-exclusive license) to all third parties to use the photo, i.e. to reproduce, distribute, process and make public in any way and/or form for non-commercial purposes of promoting tourism, improving image and raising awareness of Lithuania. By uploading a photo on the Website, the user also grants an authorisation (a non-exclusive license) to use the photo in the specified ways and for the specified purposes in mass media, including blogs, open profiles of social networks (Facebook, etc.) and content sharing platforms (Youtube, Instagram, etc.), even if this could lead to generating commercial benefits for the person who uses the photo. An authorisation (a non-exclusive license) shall be granted for the whole period of validity of the property rights of the author and shall be valid across the world. The author of the photo shall not be paid any fee for the use of the uploaded photo.
Use of photos
The responsibility for the proper use of photos shall rest upon the person using the photo who undertakes to use the photos in compliance with provisions of legal acts of the Republic of Lithuania.
It shall be strictly prohibited to use the photos in advertising of alcohol, tobacco, gambling, quick credits and other information that has a negative impact on minors.
Removal of photos
The Website Administrator shall have the right to remove the photos which do not comply with provisions of legal acts of the Republic of Lithuania without a prior notice and without indicating the reasons.
Each interested person who considers that the photo posted on the Website infringes his rights, should report the infringement to the Website Administrator by e-mail address: info@realisbeautiful.lt .
The report on the infringement must specify:
- the particular photo which possibly infringes the copyrights and its URL;
- the manner of possible infringement of the author’s rights;
- the data (the author, publisher, date, etc.) of the work in respect of which the infringement is possibly made.
The Website Administrator, having received the report on the infringement of the copyrights of the photo, shall suspend the access to the photo until the circumstances of the situation are investigated.
Liability of the Website administrator
The Website Administrator shall not be responsible for the information provided on the Website which does not correspond to reality and for the content of such information.
Although the website, as a rule, operates without disruptions, the Website Administrator cannot guarantee that the photo posted on the Website will not be infected with computer viruses, will not be damaged or lost due to circumstances that do not depend on the Website Administrator; that operation of the Website will not be disrupted due to circumstances that do not depend on the Website Administrator; that the Website administrator will completely recover the damaged or lost photo or restore the disrupted operation of the Website. The Website Administrator shall not be responsible for the loss of photos due to circumstances that do not depend on the Website Administrator.
The Website Administrator cannot guarantee that the photos uploaded onto the Website are completely safe and are incapable of damaging your software or hardware. By using the Website, you assume the responsibility for the costs of adjustment, repair or recovery of your damaged software or hardware.
The Website Administrator shall have the right to terminate operations of the Website at any time without any prior notice.
